General question qualification query

Hi guys,

I have recently been asked to take on a supervisor role at my setting, however they have told me that they can not pay me a supervisor's wage as "a person can not be made a supervisor until they have had a relevant qualification for three years". My question is, is there any legislation anywhere to validate this?
I have had a level 2 qualification for 2.5 years, and a level 3 qualification for almost 2 years, and have been working at the setting for almost 4 years.

absolute tosh. its their policy certainly not in any legislation anywhere certainly no the eyfs

as a level 3 you have a license to practice which means you are qualified to work alone unsupervised in a supervisory position
