All settings should have insurance and public liability insurance. I suspect if we all read the fine print, it probably states that if you are working in the setting or going on an outing and your setting does not maintain the required adult/child ratios your insurance is null and void.
What organisations ensures/checks everything is in order:
Ofsted, County Early Years, The Manager/Supervisor, The Committee, Parents, Staff - everyone who is involved in the setting really. If you were a staff member and your setting was not maintaining adult/child ratio, you would be expected to inform Ofsted - one of the occasions you would put your whistle-blowing policy into action.
The answer is that a setting would never operate under the legal adult/child ratio. if an emergency arose and a member of staff was ill. you would immediately contact a relief member of staff and ask them to come in.
